1. Agreement to Terms

By accessing or using Dine Out Digital's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Services Provided

Dine Out Digital provides restaurant marketing services including but not limited to:

  • Custom website design and development
  • Online ordering systems and web applications
  • Local SEO and GEO optimization
  • Email marketing campaigns
  • Digital marketing strategy and implementation

3. Client Responsibilities

You agree to provide accurate, current, and complete information as required for service delivery. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment Terms

Payment for services is due according to the terms outlined in your service agreement. Late payments may result in service suspension. All fees are non-refundable except as expressly stated in your service agreement.

5. Intellectual Property

Upon full payment, you will own the final deliverables created specifically for you. Dine Out Digital retains ownership of any pre-existing materials, code libraries, and proprietary systems. We reserve the right to showcase completed work in our portfolio.

6. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties without written consent, except as required by law.

7. Limitation of Liability

Dine Out Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Termination

Either party may terminate services with written notice as specified in the service agreement. Upon termination, you remain responsible for all outstanding payments for services rendered.

9. Modifications

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
